Reading of the Agenda

Move to amend the Agenda by adding an email request from Pat Cassell on the subject of the “Pump House” and to add the approval of the September 15, 2011 BOS Minutes.

Public Comment

Ellen Stone Chairman of the Sherborn Cultural Council appeared before the Board to inform them that she will be leaving the Sherborn Cultural Council as the Chairperson as she has fulfilled the maximum allowed amount of required terms. She also stated the Council is looking for a treasurer.  Ms. Stone stated that by not having the required amount of members the Cultural Council is in jeopardy of loosing grant money.

The Board thanked her for coming forward and asked that if anyone is listening that would like to become a member of the Cultural Council to please contact Ellen.


Pat Cassel informed the Board that the “Pump House” Project is moving forward to repair the water intake facility at Farm Pond but still needs volunteers who have skills in Construction. The Board asked that anyone interested in working on the Pump House Project should call Pat Cassell.

Pat Cassell also stated that there is a Transfer Station rule that only one barrel a week of construction debris materials maybe brought into the Transfer Station for disposal.  She informed the Board that Ron Buckler has offered to pick up the debris from the Pump House repair job site and take it to the transfer station if the Board was willing to waive the disposal rule.

Move to approve and waive the disposal rule of only one barrel a week of construction debris that maybe brought to the transfer station.

Memorandum of Agreement
Between the Town of Sherborn and
AFSCME, Council 93, Local 335 CM&D

Move to sign the Memorandum of Agreement between the Town of Sherborn and AFSCME, Council 93, Local 335 CM&D effective July 1, 2011 through June 30, 2014, subject to Town Meeting appropriating the necessary funds.

Press Release
FLSA – Department of Labor
US Dept of Labor – Letter Dated September 19, 0211
Consent Decree

Selectman DeRensis read a letter from the US Department of Labor which spells out the Minimum Wage/Overtime violations and payment of Back Wages. (Letter will be attached as part of the minute’s records

Selectman DeRensis then read a Press Release as it relates to the FLSA Audit that was conducted the Federal Department of Labor (Press Release will be attached as part of the minute records)

Move to authorize the Chairman to sign the FLSA Consent Decree on behalf of the Board of Selectmen of Sherborn.

Selectman Reports/Future Agenda Items

Selectman Pucci stated that the Town Administrator Search Committees continues to work towards an Interim/Permanent Town Administrator Screening process on a parallel track as the Collins Institute completes its report.

Selectman Pucci thought that it would be a good idea to have the Committee come before the Board to discuss its progress.

Selectman Pucci also expressed his interest with inviting the Planning Board to a future meeting to discuss the downtown district.

Selectman Pucci also asked that the Board discuss the possibility of forming a Financial Levitation Committee and asked that this also be placed on a future Agenda.

Selectman DeRensis stated that he had attended a Personnel Committee Meeting in which the Town Clerk was there to discuss a small change in the Job Description of a vacancy that she has in her Department. The vacant position is a benefited 21.5 hour position which means that costly benefits of health insurance and pension benefits apply.

Selectman DeRensis requested that we invite the Town Clerk to our next meeting to discuss this vacancy, to see if two positions be separately filled in accordance with the lawful job descriptions, which would save taxpayers an estimated $25-30,000 (an estimate supplied by the Town Treasurer).  The Board agreed and authorized the Chair to send an invitation to the Town Clerk to attend our next meeting and advise the Town Clerk not to fill the vacancy until she meets with the BOS.

Move to adjourn and to go into Executive Session to discuss litigation as it pertains to Helene Karl and Associates and the Town of Sherborn.

The Chairman stated that to discuss this in public session may have a detrimental affect on the outcome. The Chairman stated that the Board would not be returning to public session
